In this Privacy Policy of Take it Personally B.V., we explain how and for what purposes we process your personal data and what your rights are.

1. About

The Data Controller, Take it Personally BV. a private company with limited liability, having its statutory seat in Amsterdam, the Netherlands and registered address at Daalwijkdreef 47, 1103AD Amsterdam, and registered with the trade register of Netherlands under number 75777568 (“Data Controller”, “we”, “us”, “our”), pursuant to the General Regulations for the Protection of Personal Data no. 2016/679 (“Regulations”), informs users that their personal data will be processed for the purposes and in the manner described below.

This policy on the processing of personal data (“Policy”) refers to the processing of personal data of users carried out by the Owner through the site www.takeitpersonally.app (“Site”) and the Take it Personally (tiP) application, which can also be used as a web app at www.mytip.app (“App”), (collectively “the Platform“) and describes the methods and purposes of collection and processing of personal data relating to users who surf, interact, register, request or use the services offered on the Platform.

By accessing and using our Platform, you agree to be bound by this Privacy Policy and Terms of Service at all times.

2. The purpose of this Privacy Policy

This Privacy Policy aims to help you make informed decisions when using our Site and our Products and Services. We urge you to take the time to read and understand it carefully, as it sets out your rights with regard to our processing of your personal data. This Policy should be read in conjunction with our Terms of Service.

This Privacy Policy explains our approach to collecting and processing your personal data, whether obtained directly from you or from a third party, and the reasons for which we do so. Personal data, as defined in this Policy, refers to any information that pertains to an identifiable living individual, such as their name, identification number, location data, online identifier (e.g., IP address), or other factors that are specific to them, including physical appearance.

Please note that this Privacy Policy applies only to your personal data obtained by us, whether directly or from a third party. It does not cover personal data collected by third parties during your interactions with them or your use of their products or services

3. Who we collect personal data about

The following individuals are the source of the personal data we collect and process:

  • Site visitors: When you visit our Site, we collect and process your personal data as part of your interaction with us and our Site.
  • Platform users: When you register an account on our Platform, we collect and process your personal data as part of your interaction with us and our Platform.
  • Tipped: If you register with us to collect tips, we may collect and process your personal data as part of our obligations to you under our Tipped User Terms.
  • Tipper: If you use our Platform to give tips, we collect and process your personal data to collect and pass on your tip to the Tipped user, and to provide them with information about your tip, such as when and where you tipped.
  • Business: If you purchase our Products and Services, we may collect and process your personal data in connection with the supply of goods or services to you.
  • People who contact us with enquiries: If you contact us with an enquiry, complaint or feedback through our Platform, we collect and process your personal data in connection with your interaction with us.
  • People who work for our customers and suppliers: If you work for a customer or supplier and handle orders or our account with your organisation, we may process your personal data in connection with your organisation’s relationship with us.
  • Event attendees: If you attend an event hosted by us, we will process personal data about you in connection with your attendance at the event, such as when you complete a registration or feedback form.
  • Job applicants: If you apply for a job with us, we will collect and process your personal data in connection with your application.

4. What personal data we collect

In short, we only use your personal data for specific purposes, including enabling you to use Take it Personally, keeping you informed about our company, and gaining general insights into how our platform is used.

The types of personal data we collect depend on your role and use of our Platform, and may include:

  • Identity Data: first, last name and profile picture or avatar
  • Contact Data: email address, telephone number, and social media handles
  • Profile Data: username, and any other personal data you provide when registering an account
  • Employment Data: data about your job title, when and where you have worked
  • Transaction Data: details about payments made between you, other users and us
  • Technical Data: IP address, browser type and operating system, geolocation (to ensure we show you the correct information), and any other unique numbers assigned to your device
  • Marketing and Communications Data: marketing and service communication preferences
  • Behavioural Data: data relating to your browsing activity or interaction with our emails, obtained through cookies, pixel tags, and similar technologies, as well as information about your session start times and details about products you viewed or purchased

Please note that this Privacy Policy only applies to personal data obtained by us, whether directly or from a third party, and not to personal data collected by third parties during your communications with them or use of their products or services.

For example we use third party payment processor Stripe. As a part of account creation in out Platform you must complete onboarding with Stripe. Stripe will require you to submit KYC information and financial data (bank account details or card details, etc). We don’t have access to and don’t store your Financial or KYC data, it is processed by Stripe (one of the biggest and trusted payment processor). You can see Stripe Service Agreement for details.

5. How we use your personal data

  • When you browse our Site: we collect and process Behavioural Data and Technical Data to help us understand how you are using and navigating our Site. We do this to better understand which parts of our Site are more or less popular and improve the structure and navigation of our Site.
  • When you create an account on our Platform: we ask you to submit your Contact data: phone number and email address (not visible to other users) and Employment Data, it is is required to verify your account. We also ask to submit your Identity Data: first and last name (not visible to other users) and your picture or avatar, display name (visible on your public profile).
  • To start using our Platform: we will ask you to complete onboarding with our third-party payment processor Stripe. You will be directed to submit you Identity (date of birth, adress,and other KYC information) and Financial data (bank account, etc). We don’t process, don’t have access or store your Financial and KYC data. It is fully outsoursed to Stripe – one of the bigest and trusted payment processors.
  • When using our Platform: we will process Technical Data and Behavioural Data to help us improve our Platform and our Services. We will also process Marketing and Communications Data to administer your account and contact you about your account. When tips are received via our Platform we will also process Transactional Data (amount of tips, where and when tips were paid, etc).
  • When paying tips via our Platform: as a tipper you don’t need to download the app or create an account on our Platform. To send tips the tipper scans QR and will be redirected to the webapp. We proccess Transactional Data (amount of tips, where and when tips were paid), Technical and Behavirolal Data to improve our services. Please note, all Identity and Financial Data are processes by third-party payment provider. We don’t have access to it.

6. Cookies

We and our partners utilize various technologies such as cookies, web beacons, and pixel tags (collectively referred to as “Cookies”) to collect data from the devices you use to access our Site, Products, and Services, as well as emails we send you. The data collected includes Behavioral, Technical, and Profile data.

We analyze the data collected to assess how you use our Site, Platform, and Services, and to evaluate their effectiveness. This analysis is carried out for the following purposes:

  • To personalize online advertising for you
  • To evaluate the effectiveness of our Site, Products, and Services
  • To determine the number of visitors to our Site and track visitor browsing habits, enabling us to improve our Site and email effectiveness
  • To measure content effectiveness and identify which aspects of our Site are most appealing
  • To comprehend customer preferences and create targeted marketing content
  • To assist in future product and service selection, website design, and to remember your preferences
  • In some email messages, we may use a “click-through URL” linked to specific websites we administer, tracking click-through data to gauge interest in particular topics and communication effectiveness.

Regarding legal basis for processing, we rely on consent for personal data collected through non-essential cookies. In certain circumstances, we may rely on other lawful bases, such as our legitimate interest in using personal data collected through analytics cookies to improve our Site and Platform and Services. 

7. On what lawful basis do we process your personal data?

We process your personal data to be able to conclude and perform the agreement with you, which is the agreement for the use of Take it Personally, as well as to fulfil our legal obligations for administration purposes and for our legitimate interests (sending news and service emails, responding to reports, communicating with you).

For specific manners of use of your personal data we ask your consent in Take it Personally, for example for sharing your location and when you chose to show your telephone number and/or email address as a professional user.

8. How can you manage your personal data?

Editing the information in your account:

You can edit the information in your account at any time.

Downloading your personal data from your account:

You can request to download your personal data from your account through your account settings. The data will be sent to the email address registered in your account within five working days.

Deleting your account:

You can delete your account at any time. You can find the delete button in your settings.

Separate requests:

You also have the right to have your personal data restricted, to access it, to have incorrect personal data corrected, to object to processing of your personal data and to ask for an archive of your data processed electronically on the basis of consent or for the performance of the agreement we have with you.

You may also lodge a complaint with a supervisory authority.

9. With whom do we share your personal data?

We share your personal data with the service provider that hosts the Take it Personally app. Your personal data are stored in the European Economic Area.

We may, incidentally, be obliged to share certain personal data with third parties, on the basis of legally binding orders.

10. How long is your personal data stored?

Your personal data is stored for as long as it is necessary, given the purpose for which it is processed:

  • The information in your account is stored for as long as you have your account. When you delete your account, all information is deleted from Take it Personally.
  • The information in your timeline will also be removed after you delete your account; it will be removed from other users’ timelines on which you appear.
  • Personal data included in communication with other users will be stored in those other users’ accounts until they delete their accounts.
  • Personal data in communication with you will be stored for a period of 5 (five) years.
  • Personal data related to reports are kept as long as this is necessary to handle the report and for a period of 5 (five) years after the report is closed.

12. Can we update this Privacy Policy?

If there are important changes in the processing of your personal data, we will have to update this Privacy Policy to reflect those changes. We will notify you of such changes by email or through a notification in Take it Personally. Non-important changes would be an update of our contact details.
