In this Privacy Policy (“Policy”), we explain how and why we process your personal data and what your rights are to help you make informed decisions when using our website https://takeitpersonally.app (referred to as the “Site”), web portal for the Business available at https://portal.mytip.app, web app for the Tipper available at https://guest.mytip.app (both referred to as the “Web App”), and the mobile application (“the App”). In this Policy, we refer to the Site and the App together as “the Platform.”

We urge you to take the time to read this document carefully so that you understand it, as it sets out your rights with regard to our processing of your personal data. This Policy should be read in conjunction with our Terms of Service. When you use our Platform, you agree to our privacy and data protection practices as described in this Policy. If you do not agree with these practices, please do not use our Platform.

This Policy explains our approach to collecting and processing your personal data, whether obtained directly from you or from a third party, and why we do so. Personal data, as referred to in this Policy, means any information that relates to an identifiable individual, such as a name, identification number, location data, online identifier (for example, an IP address or device identifier), or other factors that are specific to a particular individual, including physical appearance. Identifiable means that a single piece of personal data might directly identify an individual or more than one piece of personal data could be used together to identify an individual.

Please note that this Policy applies only to your personal data obtained by us, whether directly or from a third party. It does not cover personal data collected by third parties during your interactions with them or your use of their products or services, including if you follow a link from our Site or App to a third-party website or application.

The Platform and its services are made available by companies in the Take it Personally group of companies (each a “Group Company”).

Where this Privacy Notice refers to “Take it Personally”, “we”, “us”, or “our”, this means one or more of the Group Companies will provide  Services to you.

Each Group Company is an independent controller of your personal data.

2. Who do we collect and process personal data from and about?

We collect and otherwise process personal data from the following categories of individuals:

  • Site Visitors: When you visit our Site, we collect and process certain types of personal data through your interaction with us and our Site.
  • Platform Users: When you register for an account on our Platform, we collect and process your personal data as part of your interaction with us and to service your account on our Platform.
  • Tipped User: If you register with us to collect tips, we collect and process your personal data as part of our services to you as described in our Terms of Service and to fulfil legal obligations we may have.
  • Tipper: If you use our Platform to give tips, we collect and process your personal data to give your tip to the Tipped User and to provide them with some information about your tip, such as when and where you tipped them.
  • Business: If you engage us for services on behalf of your business, we may collect and process personal data about your business users and your employees as part of our services to you.
  • People who Contact Us: If you contact us with a question, complaint or feedback, we collect and process your personal data in connection with your interaction with us.
  • Event Attendees: If you attend an event hosted by us, we will process personal data about you in connection with your attendance at the event, such as when you complete a registration or feedback form.
  • Job Applicants  : If you apply for a job with us, we collect and process your personal data in connection with your application and our evaluation of it.

Our Platform is not intended for children under the age of 16, and we do not knowingly collect personal data from children under the age of 16.

3. What types of personal data do we collect and process?

The types of personal data we collect and process will depend on how you use our Platform. For instance, we collect limited personal data from people who merely browse our Site, but more personal data will be needed from people who register and use our Platform for tipping. If you apply for a job with us or reach out to us with a question, we will collect additional personal data as needed to evaluate your eligibility for employment or respond to your question. In general, the types of personal data we collect and process include:

  • Identity Data: first and last name, username and a profile picture or avatar
  • Contact Data: email address, telephone number and social media handles
  • Employment Data: details about your job title and employment history
  • Transaction Data: details about payments made between you and other users or to us
  • Technical Data: IP address, browser type and operating system, geolocation (to ensure we show you the correct information), unique numbers assigned to your device and data relating to your browsing activity or interaction with our emails, which may be obtained through cookies, pixel tags and similar technologies, as well as information about your session start times and details about products you viewed or purchased
  • Marketing and Communications Data: marketing and service communication preferences, including preferred method of communication, as well as personal data you may provide in communications to us, such as through our WhatsApp click to chat feature for customer support or via email or phone communications

Note that we use Stripe as our trusted third-party payment processor. As a part of account creation in our Platform, Tipped user must also complete onboarding with Stripe. Stripe will require Tipped user to submit KYC information (such as full name and associated businesses) and financial data (such as bank account or payment card details). We don’t store this data. It is processed by Stripe, and you can review information in Stripe’s Privacy Center for more details about their practices.

4. How do we use personal data?

In short, we only use your personal data for specific purposes, including enabling you to use our Platform, keeping you informed about TiP, and gaining insights into how our Platform is used. Here are some common ways we use personal data:

  • When you Browse our Site: We use Technical Data to help us understand how you are using and navigating our Site. We do this to better understand which parts of our Site are more or less popular and improve the structure and navigation of our Site. We also use this information to resolve technical issues with the performance of our Site.
  • When you Create an Account on our Platform: We ask you to submit Identity and Contact Data, so that we can verify your account (typically done through an SMS verification process), create and service it and communicate with you about your account. We also ask you to submit certain Identity Data, such as your picture or avatar and a display name that will be visible on your public profile. To start using your account on our Platform, you will need to complete onboarding with our third-party payment processor, Stripe, as well.
  • When Using our Platform: We process Technical Data to help us improve our Platform and our services. We will also process Marketing and Communications Data to contact you, when you permit it, about updates, new service offerings and other general information about our company and related services. When tips are received via our Platform we process Transaction Data to ensure the tips are made to the correct person and to meet our legal obligations.
  • When Tipping Using our Platform: Tippers don’t need to download the App or create an account on our Platform. To send tips, the tipper only needs to scan a QR code that redirects to our web app. We process Transaction Data and Technical Data to make sure the tips are processed and allocated correctly and internally to improve our services. All associated Identity Data and financial details are processed by Stripe, our third-party payment processor, and we don’t access and don’t store that information on our Platform.

5. How do we share your personal data?

We share personal data when legally permitted, implementing appropriate security measures and contractual safeguards. We may share data with:

Service providers: the Platform hosting companies, payment processors (such as Stripe), IT vendors for system maintenance and security, customer relationship managers and other companies who assist us with administration, marketing and advertising agencies for campaigns and promotions

Legal and regulatory bodies: law enforcement agencies, government regulators,  and courts

Other parties in business transactions: potential buyers during a company sale, merging entities in case of a merger, legal and financial advisors

Analytics and research partners: data analytics firms to improve our services and market research companies for industry insights

Business users: We provide business users  with limited data about their employees using our Platform in various reports, however we don’t share individual tip amounts.  

6. Cookies

How We Use Cookies

We and our partners use various technologies such as cookies, web beacons, and pixel tags (collectively referred to as “Cookies”) to collect Technical Data from the devices you use to access our Platform, use our services or read our emails.

We analyse the Technical Data collected to assess how you use our Platform and services, which helps us evaluate their effectiveness, improve them and market them as well as for the following purposes:

  • To determine the number of visitors to our Site and understand their browsing habits
  • To measure content effectiveness and identify which aspects of our Site are most appealing
  • To understand customer preferences and create targeted marketing content
  • To personalize our online advertising
  • To remember your preferences and help with your account login

In some email messages, we may use a “click-through URL” linked to specific websites we administer, tracking click-through data to gauge interest in particular topics and communication effectiveness. We also may use clear pixels in emails to track whether our emails are opened and read. To opt-out of receiving our marketing communications, please click the “unsubscribe” link in any marketing communication you receive.

Additionally, we offer social media sharing features or other integrated tools to let you share information about us on your social media, such as Facebook, LinkedIn or Instagram. The visibility of any content you share will depend on the settings you choose for the social media site through that site’s settings. Your interactions with social media features are governed by the privacy policies of the social media companies that provide them.

Your Choices about Cookies

You can choose to block Cookies when you visit our website, but some parts of our Platform may not work as expected when Cookies are blocked. Blocking Cookies will not prevent you from receiving advertising from us or other companies, but the advertising you see may not be as relevant to you or your interests.

  • Browser-Based Opt Outs: You may be able to disable Cookies using your web browser settings. Please review your browser’s instructions or visit All About Cookiesfor general information.
  • Self-Regulatory Program Opt Outs: Two self-regulatory programs are available to help you control the use of Cookies on your browsers and in apps — the Digital Advertising Allianceand the Network Advertising Initiative. Both programs help to regulate participating vendors in the digital advertising space. One function of their self-regulatory programs is to give you the ability to opt out of targeted advertising, including the use of Cookies, from their member companies. You can visit the Digital Advertising Alliance’s Your Ad Choices website to opt out of targeted advertising for participating vendors or use their AppChoices tool to adjust your mobile device advertising preferences. The Network Advertising Initiative similarly assists with opt outs through their Opt Out of Interest-Based Advertising webpage or, to opt out in mobile apps, visit their Mobile Device Opt Outs
  • App Deletion. You can stop all collection of personal data by our App by simply uninstalling it using the standard uninstall process for your device.

Be aware that you will need to opt out separately on each browser or device you use, as opt outs are typically specific to a single browser or device. Resetting your device and other actions you take to remove information from your device or browser may remove your opt-out choices or prevent them from working as intended.

7. What lawful bases do we rely on for processing your personal data?

In some locations, we may only process your personal data when we have a legal basis to do so. In those locations, we process your personal data for the legal bases described below.

When you have an account on our Platform, we process your personal data to be able to perform the agreement with you, provide the services you request and send transactional emails.

We process any personal data as needed for our legitimate interests, such as operating our business, marketing our business, complying with our legal obligations and responding to questions and communicating with you.

We also may ask for your consent to use personal data, for example, when you share location data or when we collect Technical Data using non-essential cookies. 

8. How can you manage your own personal data?

Editing personal data in your account:

You can edit personal data in your account at any time. These changes take effect immediately.

Downloading your personal data from your account:

You can ask to download your personal data from your account through your account settings. Your personal data will be sent to the email address registered in your account. Please allow up to a week for this to be completed.

Deleting your account:

You can delete your account at any time. You can find the Delete Account button  in your App’s settings. 

Privacy rights you may have:

Depending on where you are located, you also may have other rights provided by law, including the right to access a copy of the personal data we have about you, to correct inaccurate or incomplete personal data, to request deletion of personal data and to object to our processing of your personal data or ask that we restrict the processing of your personal data to certain uses.

You may also lodge a complaint with a supervisory authority regarding our personal data practices. Our supervisory authority is Autoriteit Persoonsgegevens (the Dutch Data Protection Authority), or you may contact the supervisory authority where you live or work.

To exercise these privacy rights, send us an email at legal@mytip.app. Please state clearly what right(s) you are requesting and provide your name, any email address associated with your account and an email address at which we should contact you. We may reach out with additional questions to help us process your request, including questions to help us verify your identity, which we ask that you promptly respond to.

9. How long is your personal data stored?

To determine an appropriate retention period for personal data, we consider various factors such as the amount, nature, and sensitivity of your personal data; the potential risk of unauthorized access, use or disclosure; the purposes for which we process your personal data; and applicable legal requirements. Your personal data is stored for as long as it is necessary for the purpose for which it is processed. Common processing purposes and their associated retention periods are:

  • Personal data in your account is stored for as long as you have your account. When you delete your account, your personal data is deleted. Personal data available in your work history will also be removed after you delete your account, and it will be removed from other users’ work history in which you appear.
  • Personal data included in communications with other Platform users will be stored in those other users’ accounts until they delete their accounts.
  • Personal data from communications between you and us will typically be stored for 5 years.
  • Personal data related to complaints or other issues, including personal data you may provide to us via email, chat, or phone, are kept as long as necessary to handle the complaint or report and for 5 years after the complaint is resolved or the report is closed.

11. Will this Policy be updated?

If there are important changes in the processing of your personal data or in the laws applicable to us or the processing of your personal data, we will update this Policy to reflect those changes. We will notify you of any updates through revising the date at the end of this Policy and may additionally provide notice via email to you or notification in your account.
